TERMS AND CONDITIONS

 

The following is an agreement between Business of Design® (“Business of Design®”, “BOD™”, “we”, “us”) and users of businessofdesign.com and businessofdesign.mykajabi.com (the “Site” or "Sites").

By accessing the Site(s) or purchasing any products or services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you may not access or use the Site.

Your continued use of the Site constitutes acceptance of any updates or modifications made at the sole discretion of Business of Design®.

DEFINITIONS

BOD™ – Business of Design® Inc. and/or businessofdesign.com
User – any individual accessing the Site(s)
Programs – courses, trainings, or structured educational content
Digital Products – contracts, templates, documents, downloads, and courses sold via the BOD™ Shop
Membership – BOD™ Business Membership purchased prior to April 1, 2026

MODIFICATION OF TERMS

Business of Design® reserves the right to update these Terms at any time. Updates are effective immediately upon posting. Continued use of the Site constitutes acceptance.

LIMITED LICENSE

Business of Design® grants you a limited, non-exclusive, non-transferable license to access purchased content for your personal business use only.

You may not copy, distribute, resell, sublicense, or share any content unless expressly permitted.

FEES, PAYMENTS AND CURRENCY

All prices are listed in U.S. dollars unless otherwise stated.

You agree to pay all fees associated with your purchase.

DIGITAL PRODUCTS (BOD™ SHOP)

This section applies to all Digital Products, including contracts, templates, documents, downloads, and standalone courses.

Access

Upon purchase, you are granted access to the product for six (6) months from the date of purchase.

After this period:

  • access may expire
  • products may no longer be available for download or viewing

You are responsible for downloading and securely storing your files within this period.

Access is:

  • licensed to the original purchaser only
  • non-transferable
  • non-exclusive

You may not share, reproduce, distribute, or resell any Digital Product.

Refunds

All Digital Products are final sale and non-refundable.

Because access is granted immediately upon purchase, refunds will not be provided for any reason, including:

  • change of mind
  • misunderstanding of product
  • failure to review product details

Business of Design® is not a law firm and does not provide legal advice.

All contracts and documents are provided for educational purposes only. You are responsible for:

  • consulting a qualified legal professional in your area
  • ensuring compliance with applicable laws

Format and Usage

Some Digital Products are provided in PDF format only to preserve content integrity and legal disclaimers.

You are responsible for:

  • transferring content into your own working documents
  • formatting and branding
  • customizing content for your business

It is recommended that content be copied one page at a time to avoid formatting issues.

User Responsibility

You are solely responsible for:

  • reviewing all materials
  • customizing documents
  • obtaining legal approval prior to use

Business of Design® makes no guarantees regarding legal enforceability or business outcomes.

BOD™ PROGRAMS

For all digital (on demand) and live virtual programs: 

  • access is granted for the specific term of the program
  • access expires at the end of that term
  • all programs are non-refundable; digital (on demand) programs are non-transferable
  • for live virtual programs only, transfers to a future session may be permitted at the sole discretion of Business of Design®
  • content may be updated, modified, or removed at any time

PAYMENT PLANS

If you select a payment plan:

  • you must complete all scheduled payments
  • failure to make a payment results in immediate termination of access

Business of Design® may:

  • revoke access without notice
  • require full payment to restore access
  • deny future payment plan eligibility

BOD™ MEMBERSHIPS (Purchased Prior to April 1, 2026)

Memberships purchased before April 1, 2026 remain governed by the original membership terms:

  • automatic monthly or annual renewal
  • cancellation required prior to renewal
  • monthly fees non-refundable
  • annual refunds allowed within 2 business days (less $75 processing fee)

Business of Design® may adjust pricing with 30 days notice.

ACCESS AND AVAILABILITY

Business of Design® does not guarantee uninterrupted access to the Site(s) or its content.

Access may be affected by:

  • maintenance
  • technical issues
  • third-party services

We reserve the right to modify or discontinue content at any time.

PROHIBITED CONDUCT

You agree not to:

  • share login credentials
  • copy or distribute content
  • scrape or systematically download materials
  • use content for resale or training others
  • violate intellectual property rights

Violation may result in immediate termination of access.

INTELLECTUAL PROPERTY

All content on the Site(s) is owned by Business of Design® or its licensors.

No content may be copied, reproduced, or distributed without prior written consent.

DISCLAIMERS AND LIMITATION OF LIABILITY

All content is provided “as is” without warranties of any kind.

Business of Design® does not guarantee:

  • financial results
  • business success
  • specific outcomes

To the fullest extent permitted by law, Business of Design® is not liable for any indirect or consequential damages.

Total liability is limited to the amount paid for the product or program.

TERMINATION

Business of Design® may terminate access at its sole discretion if you:

  • violate these Terms
  • fail to make payments
  • misuse content

PRIVACY

Business of Design® collects personal information necessary to:

  • process transactions
  • manage accounts
  • communicate with users

We do not sell user data. Information may be disclosed if required by law.

GOVERNING LAW

These Terms are governed by the laws of Ontario, Canada.

Disputes shall be resolved by binding arbitration in Toronto, Ontario.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Business of Design®.

If any provision is deemed unenforceable, the remainder remains in full effect.
